Student Enrollment Agreement Terms and Conditions
You have enrolled in a program with TPR Education, LLC d/b/a The Princeton Review (“TPR”, “we”, “us”, “our”).
All program techniques and materials (online and print), content, code, software, data, videos, and session transcripts, copyrights, trademark rights and other intellectual and property rights used in or related to your program are the exclusive property of TPR. You agree not to disclose, reproduce, sell or distribute to any third party any information, written or spoken, including course materials, obtained from TPR in connection with TPR courses or tutoring programs. Without limiting the foregoing, you further agree not to share your online TPR password or to otherwise allow any other person to use the TPR online resources purchased by you. To the extent you need to download software or documentation to access services or materials in connection with your program, TPR grants you a limited, non-assignable, non-transferable, revocable license to use such services and materials solely for use with your purchased program or services and only for your personal, non-commercial use. Such license will terminate when your program, plan or other service expires or otherwise terminates.
You understand that for certain TPR programs, size is limited and, therefore, enrollment is taken on a first-come, first-served basis.
You are solely responsible for all telephone, computer hardware and other equipment required for access to and use of our online services.
TPR reserves the right, in its sole discretion, to change these Enrollment Terms and Conditions, in whole or in part, at any time. Changes in these Enrollment Terms and Conditions will be effective when posted.
Payment:
You agree to pay in full by credit card/debit or other payment acceptable to TPR, for your purchases of TPR products and services as follows:

For our test preparation and other programs (other than Homework Help or admission counseling services), you must pay the program deposit amount (or may pay in full) at the time you enroll. If you enroll in a classroom course, a LiveOnline program or a Small Group Instruction within ten days of the start of that program, or if you enroll in a TPR online course (other than LiveOnline) or a private tutoring program (other than Homework Help), you must pay in full at the time of enrollment (except if you are a private tutoring student, on a TPR payment plan, in which case payments are due in accordance with such plan). All students must pay in full by ten days prior to the first scheduled session of the program. If you have not paid in full by ten days prior to the first scheduled session, you authorize TPR to charge the balance of the course tuition to your payment method on file.

When you purchase a Homework Help plan, we immediately charge your credit card and put into your account the number of minutes that corresponds to your plan for the first month. On the same day of each month (or the last calendar day if you paid on the last day of a month), until you cancel, we charge your monthly fee to your credit card and refill your account with the number of minutes that correspond to your plan. When you finish a tutoring session we deduct the time you spent with the tutor from your account balance. While enrolled in an online tutoring plan for a set number of minutes of tutoring, you may also purchase single hours at a fixed rate without upgrading or downgrading your plan or changing your billing date. If you purchase a single hour, we immediately charge your credit card and add 60 minutes to your account.

For admission counseling services, you must pay upfront at the time of enrollment (unless a payment plan is agreed to before enrollment, in which case payments are due in accordance with such plan).
Student Withdrawals, Cancellations and Refunds:
If you withdraw from your TPR program or cancel your plan, you will be eligible for a refund on the following terms:

If you choose to withdraw your enrollment in a classroom course, LiveOnline course or a Small Group Instruction ten or more days before the first scheduled session of your program, we will refund all of the tuition you have paid (including your deposit). If you decide to withdraw your enrollment in a classroom course, LiveOnline course or a Small Group Instruction less than ten days before the first scheduled session of your program, we will refund all of the tuition you have paid less your deposit. No refunds will be given after the first scheduled session of the program in which you enrolled.

After your purchase of private tutoring, you have 90 days to begin tutoring, or you will forfeit all unused tutoring hours and online services. If within 48 hours after your enrollment, you choose to withdraw from a private tutoring program without using any tutoring hours, we will refund all of the tuition you have paid. If you choose to withdraw from a private tutoring program after 48 hours from your enrollment without using any tutoring hours, but within 90 days of enrollment, we will refund all of the tuition you have paid less a fee of $499.

If within 48 hours after your enrollment you choose to withdraw from any of our self-paced online programs with a cost of more than $499, we will refund all of the tuition you have paid less a fee of $499, but withdrawals after 48 hours from your enrollment are not eligible for any refund. Please note that no refunds are available for any of our self-paced online programs with a cost of less than $500.

Shipping costs will not be refunded. Also, the $50 fee paid by students on a payment plan is non-refundable.

In order to receive a refund as set out in the preceding bullet points, you must return any program materials you received to us unopened and with no marks in the materials within two weeks of withdrawing your enrollment. Shipping costs for return of materials are at your expense. If you fail to return your program materials within two weeks, or do not return them unopened and unmarked, TPR will deduct from any refund for which you are eligible the following amount:
- your deposit, if you were registered for a classroom course, LiveOnline course or Small Group Instruction
- $499, if you were registered for a private tutoring program (other than Homework Help).

Note that no refunds are available on admissions counseling services. Counseling sessions must be scheduled in advance, and are subject to the counselor's availability. If you need to reschedule a meeting, please do so in a timely manner. If you miss a scheduled meeting with your counselor, you will be charged a fee of seventy-five dollars. If you cancel a meeting within twenty four hours of your scheduled meeting time, you will be charged a fee of seventy-five dollars.

You can cancel your Homework Help (on-line on-demand tutoring) plan by visiting princetonreview.com, signing into your account and clicking the appropriate link on your account page. You may also call us at (800)411-1970. When you cancel your plan, we will stop charging your credit card and will stop refilling your account with minutes each month. Any unused minutes left in your account will be good until what would have been your next billing date, at which time they will expire and be non-refundable. Notwithstanding the above, if you cancel your Homework Help plan within 30 days of your purchase, you can call us to request a refund for any unused minutes left in the account on a prorated basis. For example, if you select a hypothetical 100-minute plan for $50 per month, use 50 of your 100 minutes and request a refund within 30 days of your purchase, we will refund $25 of your initial payment. No refunds will be made if you cancel your account after your first 30 days. Please note that for security reasons, we process refund requests only by phone, at the number set forth above.
TPR Program Cancellation:
Occasionally, due to various circumstances, TPR may change course schedules or locations, cancel a course, not have a tutor available for you for an in-person or on-line private tutoring program (the foregoing does not apply to Homework Help) or not be able to fulfill your Small Group Instruction request. If we cancel the course in which you have enrolled and are not able to reschedule you into another course that is acceptable to you, or if we are unable to match you with a tutor as described above or Small Group Instruction, we will refund all of the tuition you have paid (including your deposit), and we will have no further liability to you with regard to the cancelled program. If you have received any program materials, you must return them to us, at TPR's expense for shipping in accordance with TPR's return authorization policy, within two weeks of the program cancellation. If you fail to return materials within the two-week period, and
- if you were registered for a classroom course, LiveOnline course or Small Group Instruction, we will refund all of the tuition paid less your deposit, or
- if you were registered for a private tutoring program, TPR will deduct a fee of $399 or
- if you were registered for an self-paced online course, TPR will deduct the lower of $399 or the full price of the course.
Please note that refunds for cancellations under this or the immediately preceding section take approximately 30 days from notification of cancellation to be processed.
Prohibited Conduct; Dismissal from Program or Online Access:
You agree that you will treat TPR tutors and instructors with respect and not use obscenities, make threats or discuss matters other than those related to the subject in which you are being helped in your TPR program. TPR may dismiss you from a TPR program or cancel your services, including online access to our services if you:
- have not paid in full by the first scheduled session, or
- in TPR's opinion, are disruptive in the program, or
- do not comply with our Terms of Use set out on our website at princetonreview.com, these Enrollment Terms and Conditions, or other rules and procedures applicable to our services being provided to you.
TPR will not refund any amounts or provide any credit where a student is dismissed from a program or their services are cancelled as set forth above.
Lost Materials:
If you lose your program materials, you may purchase a replacement kit during the course of your program. Replacement material fees are:

Recorded and User Content:
You agree that we may record all or any part of any of our programs, including without limitation Homework Help tutoring sessions and voice chat communications. We reserve the right to use the recorded sessions for any purpose allowed by our Privacy Policy. You agree that we own all transcripts of tutoring and classroom sessions and all comments you may provide us through our services
For admissions counseling services, you acknowledge that you may be required to provide materials in connection with the provision of the services, and you agree to do so in a prompt and timely manner.
Any materials, information, communications, testimonials, ideas, or other content or materials or that you upload, communicate or otherwise transmit or post to us by any means (including, for example and without limitation, that which you submit or post to our chat rooms, message boards, and/or our blogs, or send to us via e-mail) (“User Content”) will be deemed not to be confidential or secret, and may be used by us in any manner consistent with our Privacy Policy. By submitting or sending User Content to us, you: (i) represent and warrant that the User Content is original to you, that no other party has any rights thereto, and that any “moral rights” in User Content have been waived, and (ii) you grant us and our affiliates a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully transferable, assignable and sublicensable right and license to display, use, reproduce, incorporate, modify, create derivative works from and distribute such material (in whole or part). We are not responsible for maintaining any User Content that you provide to us and we may delete or destroy any such User Content at any time.
Disclaimer; Limitation of Liability:
TPR will not be liable to you or to any other person for any indirect, consequential, punitive or special damages, of any character, whether in an action in contract, tort or otherwise, arising out of or in connection with your TPR program, even if TPR has been advised of the possibility of such damages. Other than the guarantee set forth below, TPR disclaims all warranties and conditions, express, implied, statutory or otherwise, including, but not limited to, implied warranties and conditions of merchantability and fitness for a particular purpose. TPR's total aggregate liability arising from or related to your TPR program will not exceed the amount you paid for your program.
In particular, but without limiting the generality of the foregoing, in relation to admissions counseling services, TPR makes no representations or warranties with respect to (a) the likelihood of success in obtaining admission to an program, (b) whether the services will enhance or detract from the strength of a client's application, or (c) any guarantee that a client will obtain admission to any program. TPR shall not in any way be liable for a client's failure to achieve admission to any program.
Governing Law:
These Student Enrollment Agreement Terms and Conditions and any claim or dispute arising out of, relating to or in connection with this Student Enrollment Agreement or the transactions contemplated hereby, whether in contract, tort or otherwise, shall be governed by and construed in accordance with the laws of the State of New York without giving effect to its conflicts of law principles. The exclusive means of resolving any such claim or dispute shall be binding arbitration administered by the American Arbitration Association. The one exception to the exclusivity of arbitration is that you have the right to bring an individual claim against Company in a small-claims court of competent jurisdiction. But whether you choose arbitration or small-claims court, you may not under any circumstances commence or maintain against the Company any class action, class arbitration, or other representative action or proceeding.
Additional Information for Students Enrolling in an MCAT Program:
As part of your MCAT program, you will have access to TPR's Online Student Center, which will provide you with access to practice tests made available by the Association of American Medical Colleges (AAMC) through a website created and supported by AAMC. You agree that you will not share your account access to the AAMC website or any digital files from the AAMC MCAT practice tests with any other person. You acknowledge that if you do so, AAMC will be entitled to immediately terminate your access to its website. You also authorize AAMC to share your practice test results, including scores, multiple choice answers and essays, with TPR.
Additional Information for Students Enrolling in a Private Tutoring Program Other Than Homework Help:
If you have purchased a private tutorial for a number of pre-scheduled hours, please note that session lengths are variable; the number of hours you have purchased does not necessarily correspond to the number of sessions you will have if you choose to meet for more than one hour at a time. Also, TPR does not refund unused tutoring hours.
Payment for Additional Tutoring Hours
If you complete more tutoring hours than the number for which you enrolled, you authorize TPR to charge your payment method on file for the additional hours you have used at the undiscounted rate of your original purchase. Without limiting the foregoing, additional tutoring hours will not be eligible for any discount, promotion or rebate. Speak regularly with your tutor throughout the tutorial so you know how many hours you have completed.
Canceling Tutoring Sessions
If you need to cancel a scheduled tutoring session, you must give the tutor 24 hours advance notice. If you fail to give 24 hours advance notice of any cancellation, the missed session will be treated for purposes of remaining tutoring hours, as if the session took place. If the tutor cancels or misses an appointment without 24 hours advance notice to you, you will receive one free session of equivalent hours to the missed session of tutoring in addition to the hours in your program.
Adult Supervision
Please note that TPR tutors are not permitted to meet in person with a minor student in a private home unless another adult is present during the entire session. If a tutor arrives for a session and an adult is not present, the tutor will not be able to conduct the session, it will be considered a session cancelled by the student without adequate notice, and you will be charged for the session. If the other adult leaves in the middle of a session with a minor student, the tutor will also leave at that time, and you will be charged for the entire session. Tutors may meet in person with minor students in public locations, such as a library or coffee shop, without another adult present.
Tutor Satisfaction
If you are not happy with the tutor we have assigned to you, please contact TPR before your second tutorial session. We will assign a new tutor and we will not charge you for the first hour of your first session with your original tutor. If you request a change in the tutor assigned to you after your second tutorial session, we will charge you for all hours used.
Forfeiture of Tutoring Hours
If after you have had your first or subsequent tutoring sessions, there is no tutoring session scheduled for you for over a 90 day period, all unused tutoring hours will be forfeited.
Additional Information for Students Enrolling in our Homework Help Program:
The hour(s) we place in your account each month are available for tutoring sessions until the end of the then current billing month. Any unused hours in your account will not “roll over” from one month to the next. While enrolled in a Plan, you may purchase additional hour(s) at a fixed rate (“Add on Hour(s)”) without upgrading or downgrading your plan, or changing your billing date. Add on Hour(s) also do not “roll over” from one month to the next and are available for use only during the billing month in which you purchased the Add on Hours.
Anonymity is a feature of our Homework Help services. You agree that you will not disclose any information to your tutor that could be considered personally identifiable information, such as your full name, address, telephone number, email address, social security number, password or any other information that could be used to identify or locate you.
Our Homework Help services are unavailable from 2:00 a.m. on each of New Year's Day, Independence Day, Thanksgiving Day and Christmas Day through 2:00 a.m. of the next day.

How do I qualify for a free prep course OR get my money back?

What does it mean to “complete all components” of an eligible program?

How do we determine if your score has improved?
You must establish a “Starting Score” prior to, or at the beginning of, your first test prep program with TPR. Your Starting Score can be either:
- The score received on the official test that was administered no more than six months prior to the start of your first TPR test prep program for the identical test; or
- The score you receive on your first practice test in your first test prep program with TPR that is for the identical test.
How do I qualify for the money back guarantee when my SAT score has improved, but by less than 100 points?
SAT Ultimate
We will give you your money back if you take any of our SAT Ultimate programs and your official SAT test score does not improve by at least 100 points and the following conditions are met:
- Your Starting Score is between 540 and 1370.
- You have completed a second TPR SAT program.
- You took the official SAT test that was administered immediately following your second TPR SAT program.
- You sent your official test score from your second official SAT test within 30 days of the official test score release.
- Your official score on the second official SAT test did not improve by at least 100 points as compared to the Starting Score you established prior to, or at the beginning of, your first TPR SAT program.
SAT Honors
We will give you your money back if you take any of our SAT Honors programs and your official SAT test score (Math and Evidence-Based Reading and Writing combined) does not improve to at least 1400 and the following conditions are met:
- Starting Score is at least 1250.
- You have not taken any TPR PSAT or SAT programs prior to taking a SAT Honors program.
- You have completed a second TPR SAT program.
- You took the official SAT test that was administered immediately following your second TPR SAT program.
- You sent your official test score from your second official SAT test within 30 days of the official test score release.

How do I qualify for the money back guarantee when my ACT score has improved, but by less than 3 points?
ACT Ultimate
We will give you your money back if you take any of our ACT Ultimate programs and your official ACT composite test score does not improve by at least 3 points and the following conditions are met:
- Starting Score is 30 or below.
- You have completed a second TPR ACT program.
- You took the official ACT test that was administered immediately following your second TPR ACT program.
- You sent your official test score from your second official ACT test within 30 days of the official test score release.

ACT Honors
We will give you your money back if you enroll in one of our ACT Honors programs and your official ACT composite test score does not improve to at least a score of 31 and the following conditions are met:
- Your ACT composite Starting Score is at least 28 with no less than 27 on any sub score.
- You have not taken any TPR ACT program prior to taking an ACT Honors program.
- You have completed a second TPR ACT program.
- You took the official ACT test that was administered immediately following your second TPR ACT program.
- You sent your official test score from your second ACT test within 30 days of the official test score release.
- Your official score on the second official ACT test did not improve to a least 31.
How do I request a free prep program OR get my money back?
To request a free prep program or to get your money back, please complete this form. Upon receipt, a TPR Advisor will contact you to develop a plan of action and get you registered in a new program to prep for the next administration of the official test or process the return of your money, whichever is applicable.
Due to limited availability of honors programs, the options available will not include Honors programs.

We are confident that your hard work plus our expert tutors will increase your grades. We guarantee that if you work with our tutors for at least two hours a month for three consecutive months, you will see an improvement in your grade in the subject we are helping you with.

To qualify for the guarantee you must work with our tutors for a total of 120 minutes per month, for each of three consecutive months, in the subject you want covered by our guarantee.
In other words, you are always welcome to have sessions with tutors in numerous subjects, but if you want to be covered by our guarantee for a particular subject, you must spend at least 120 minutes per month working in a single subject. For example: In November you spend 145 minutes in session with tutors. 125 of the minutes are with algebra tutors and 20 minutes are with writing tutors. Such a month would qualify as a full month towards the guarantee for algebra. On the other hand, if you spend 110 minutes with algebra tutors and 35 minutes with writing tutors, such a month would not qualify because you would not have spent 120 minutes with tutors in any single subject.

To qualify for the guarantee you must be a student in grade 6 through 12, between the ages of 10 and 19, enrolled in an accredited public, private, parochial, or charter school in the United States.
You must live in the United States and attend school in the United States to qualify for our guarantee. If you are enrolled in an online school, both it and you must be located in the United States, and the school must be fully accredited.

To qualify for the guarantee you must either be taking the same course across three months, or be transitioning from a natural prerequisite course without a break in time longer than a summer.
If you start working with us in the beginning of a grading period (such as a quarter, trimester, or semester), and you have yet to receive your first mid-term grade, we look to your final grade in the prerequisite course as the starting point for your grade comparison. For example, if you start working with us in September before you have your mid-term grade in Algebra II, we look to your grade in Algebra I as your starting point. If you are taking a course for which there is no natural prerequisite the clock on your three months does not begin until you have received your first grade in the course, which could be your mid-term exam. If you are unclear whether a particular course has a qualifying prerequisite course please contact us right away.

Your school/subject must report grades in a way that allows us to see your improvement.
Different schools have different grading scales and systems for measuring academic progress. We guarantee that if you work with us your grade will go up at least the equivalent of a half-step letter grade, meaning, for example, from a C to a B-, or from a B to an A-. If your school uses a numerical grading system we guarantee your grade will increase at least three points, for example from a 79 to an 82. Please note that our guarantee does not apply to schools/subjects that offer grades of A, B, C, D, and F without pluses and minuses, or other course scales such as U, S, VS, E or Pass/Fail. (If your school/subject does not have a standard grading system, we strongly encourage you to contact us now so we can let you know whether you will be covered by our guarantee.)

Our guarantee does not apply to students who start with an A in a subject, or who start with a numerical grade within 10% of the highest grade available in their school's grading system.
Working with our tutors for two hours per month is probably enough to get you from an A to an A plus but some teachers only give out a limited number of their highest grades.

You must make a good faith effort to learn the material. You must complete all major assignments and exams.
What we guarantee is that if you make a good faith effort to learn, and include us in your effort, you will see results. If your grade does not increase because you fail to show up for your mid-term, or because you did not complete an important project, paper, or take-home exam, you are not eligible for our guarantee.

Sessions for which you request credit do not count towards the requirement to spend 120 minutes per month working with our tutors.
As you likely know from our Terms of Use, we guarantee the quality of every session. If you have a session that does not meet our standards of quality, and you request (and receive) credit for that session, the time you spent in that session does not count towards your 120 minutes that month. For example, if you spend 125 minutes in algebra sessions during a month and request credit for a 15 minute session, you have only spent 110 qualifying minutes with the tutors for that month and must spend at least 10 more minutes with tutors (in your subject) that month in order for the month to count as one of the three consecutive months.

Your grade must go up (or not go up) in a way that we can confirm.
If you submit a request for a refund under our guarantee, you will be required to submit a form to us, signed by both you and your parent (or legal guardian), authorizing your school to release your records to us for verification.

If you qualify for the refund under our guarantee, we will refund you 100% of what you spent on tutoring in the qualifying subject, up to a maximum of $239.97.
In order to be considered for the Better Grades Guarantee, you'll need to purchase our 2 hour a month package at $79.99 per month. If you qualify for the refund, you'll get back the cost of the tutoring up to $239.97 which is what you would spend for three months of 2 hours of tutoring per month.
There is a limit of one refund per household and/or family.

Refunds will be issued in the form and manner chosen by The Princeton Review.
This means that we reserve the right to refund a credit card or mail a check as circumstances dictate. It also means that we use our judgment when determining to whom the refund will be issued. (Our default rule is we will refund the person who paid for your tutoring.)
The Princeton Review reserves the right to update the foregoing guarantees at any time.
